EU Compliance — FlaxseedsPro (European Market Access)¶
Scope: FlaxseedsPro products (whole flaxseed, milled/ground flaxseed, flaxseed oil) placed on the European Union / European Economic Area market. Covers EU food law, labelling, claims, organic certification, novel foods, and RASFF obligations.
1. EU General Food Law — Regulation (EC) 178/2002¶
1.1 Foundational Principles¶
Regulation (EC) 178/2002 establishes the general principles and requirements of food law in the EU. It applies to all stages of the food chain, including import.
Key principles relevant to FlaxseedsPro:
- Risk Analysis (Article 6): EU food law is based on risk assessment (scientific), risk management (policy), and risk communication. FlaxseedsPro must ensure any claims or safety assessments are scientifically substantiated.
- Precautionary Principle (Article 7): Where scientific uncertainty exists about a potential health risk, the EU may adopt provisional risk management measures. Relevant for novel flaxseed fractions or high-lignan extracts.
- Protection of Consumers' Interests (Article 8): Food must not be misled by labelling, presentation, or advertising.
1.2 Traceability — Article 18¶
Mandatory one-step-back, one-step-forward traceability at all stages of production, processing, and distribution:

1.3 RASFF — Rapid Alert System for Food and Feed¶
- RASFF (Articles 50–52): A system for notifying food safety risks across EU member states. If a flaxseed product poses a serious risk to human health, FlaxseedsPro must:
- Immediately notify competent authorities of the member state where the product is placed (or withdraw from market)
- Co-operate with the RASFF contact point
- Implement trace forward/back to identify all affected batches
- Common RASFF notifications for flaxseed: Salmonella (in seeds), aflatoxins (rare but monitored), ochratoxin A, undeclared allergens
1.4 Food and Feed Business Operator Obligations¶
As a food business operator (FBO) placing flaxseed on the EU market, FlaxseedsPro must: - Ensure food safety (Article 14) - Withdraw unsafe food from the market (Article 19) - Inform competent authorities of any non-compliance (Article 19)
2. EU Hygiene Regulation — Regulation (EC) 852/2004¶
2.1 General Requirements¶
All EU food businesses must implement:
- HACCP (Hazard Analysis and Critical Control Points) — Article 5:
- Must be based on the Codex Alimentarius HACCP principles
- Documented HACCP plan specific to flaxseed products
- Critical control points include: metal detection (whole/milled flaxseed), drying to < 10% moisture, temperature control for oil products

Prerequisite Programmes (PRPs) — Annex II:
- Facilities must meet structural and hygiene requirements: cleanable surfaces, pest control, waste management, water quality

- Pest control: flaxseed is susceptible to stored-product moths (Ephestia kuehniella, Plodia interpunctella) and beetles (Tribolium spp.)
- Maintenance and cleaning: schedules must be documented and verified

2.3 Registration of Food Business¶
FlaxseedsPro must register each food establishment (facility) with the competent authority of the EU member state where operations are based.
3. EU Food Information to Consumers (FIC) — Regulation (EU) 1169/2011¶
3.1 Mandatory Food Information¶
All prepackaged flaxseed products must display in a legible, indelible, and easily visible manner:

3.2 Allergen Labelling — 14 Mandatory Allergens¶
The FIC Regulation requires declaration of 14 allergen groups (Annex II):
- Cereals containing gluten (wheat, rye, barley, oats, spelt, etc.)
- Crustaceans and products thereof
- Eggs and products thereof
- Fish and products thereof
- Peanuts and products thereof
- Soybeans and products thereof — relevant if flaxseed is processed on shared equipment with soy
- Milk and products thereof (including lactose)
- Tree nuts (almonds, hazelnuts, walnuts, cashews, pecans, pistachios, etc.)
- Celery and products thereof
- Mustard and products thereof
- Sesame seeds and products thereof — relevant for cross-contact if co-processed
- Sulphur dioxide and sulphites (> 10 mg/kg or mg/L)
- Lupin and products thereof
- Molluscs and products thereof
Note: Flaxseed itself is not one of the 14 mandated allergens under EU law. However, cross-contact from shared facilities or equipment must be declared with precautionary allergen labelling (PAL) such as "May contain traces of..."
3.3 Country of Origin Labelling¶
Article 26 requires country of origin labelling: - For products where the main ingredient originates from a different country than the product's declared origin - For fresh, chilled, and frozen meat (specific categories) - Flaxseed oil and milled flaxseed: if the origin of the raw material (e.g., Canada or Kazakhstan) differs from the processing country, both must be indicated

Flaxseed-specific nutrition values (typical per 100 g whole seed): - Energy: ~2,234 kJ / 534 kcal - Fat: ~42 g (saturates ~3.7 g, MUFA ~7.5 g, PUFA ~28.7 g — mainly ALA) - Carbohydrate: ~29 g (of which sugars ~1.5 g) - Fibre: ~27 g - Protein: ~18 g - Salt: ~0.08 g
4. Nutrition & Health Claims — Regulation (EC) 1924/2006¶
4.1 General Requirements¶
All claims on flaxseed products must comply with the EU Nutrition and Health Claims Regulation (NHCR). Claims must be: - Scientifically substantiated (based on generally accepted scientific evidence) - Not ambiguous or misleading - Based on ex-ante authorisation by the European Commission for health claims
4.2 Nutrition Claims Relevant to Flaxseed¶
Only nutrition claims listed in the Annex of Regulation 1924/2006 are permitted:

4.3 Authorised Health Claims (Article 13.1)¶
Only EFSA-authorised health claims may be used. Relevant claims for flaxseed:

Important: Article 13 health claims must be accompanied by: - The full authorised wording as published in EU Register of Nutrition and Health Claims - A statement on the importance of a varied, balanced diet
4.4 Nutrient Profiles (Article 4)¶
The EU Commission has proposed (but not yet adopted as of 2026) nutrient profiles that products must comply with to bear health/nutrition claims. Flaxseed oil is naturally high in fat, which may affect eligibility once profiles are finalised.
5. EU Organic Regulation — Regulation (EU) 2018/848¶
5.1 Regulatory Framework¶
From 1 January 2022, Regulation (EU) 2018/848 replaced EC 834/2007 and EC 889/2008. Key changes for organic flaxseed:
- Group certification: Permitted for smallholder groups under strict rules
- Mandatory computerised certification system (TRACES)
- Imported organic products must comply with equivalent production rules (or be certified by an EU-recognised control body)
5.2 Organic Certification Requirements for Flaxseed¶

5.3 Equivalency for Imports¶
Non-EU organic flaxseed can be imported into the EU under: - Trade agreements with recognised third countries (Canada, US under NOP equivalence — note EU-US Organic Equivalence Arrangement) - Compliance agreements with EU-recognised control bodies (e.g., Ceres, ECOCERT, Soil Association Certification) - Catch-all provision: Products certified by an EU-recognised control body in the country of origin
6. EU Novel Foods Regulation — Regulation (EU) 2015/2283¶
6.1 Applicability to Flaxseed¶
Traditional flaxseed (whole, milled, cold-pressed oil) is not a novel food — it has a history of consumption in the EU prior to 15 May 1997.
However, the following flaxseed-derived products may be classified as novel foods: - Hydrolysates or protein isolates from flaxseed — considered novel unless demonstrated safe by traditional use - Highly concentrated lignan extracts (secoisolariciresinol diglucoside — SDG) — classified as novel food; FlaxseedPro's LinLife SDG ingredient is a novel food - Fermented flaxseed products or enzymatically modified fractions
6.2 Authorisation Process¶
For novel flaxseed ingredients: 1. Submit a novel food application to the European Commission (via the e-submission portal) 2. EFSA conducts a scientific assessment (9-month timeline, may be extended) 3. Commission authorises via implementing regulation with conditions of use, labelling requirements, and specification 4. Data protection (5 years) may be granted for proprietary scientific evidence
6.3 Conditions of Use (Example — SDG Flaxseed Extract)¶
A hypothetical authorisation for a concentrated flaxseed lignan extract would specify: - Maximum daily intake (e.g., 50 mg SDG) - Target population (adults, excluding pregnant/nursing women) - Labelling statement: "Not recommended for pregnant or breastfeeding women" - Specification: Purity, SDG content (> 20%), solvent residues, microbiological criteria
7. RASFF Notification Process¶
7.1 When to Notify¶
FlaxseedsPro must notify competent authorities immediately via the RASFF system (through the relevant national contact point) when:

- Co-operate with national competent authorities (e.g., FSA in UK, ANSES in France, BVL in Germany)
